Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Stay Fit mobile application and the website at https://gostay.fit (together, the “Service”), operated by Stay Fit (“Stay Fit,” “we,” “us,” or “our”).

By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle information.

1. The Service

Stay Fit is a free workout and fitness tracking application. Core features may include guided and custom workouts, logging (sets, reps, weight, rest), progress views, goals, body measurements, themes, reminders, and local backup/export tools. The Service is designed to work offline-first, with data primarily stored on your device.

We currently do not charge a subscription fee for the core app experience described on gostay.fit. We may change features, update the app, or offer optional future capabilities; if pricing or material terms change, we will update these Terms and relevant store listing information as required.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age of legal majority where you live, you may only use the Service with permission from a parent or legal guardian who agrees to these Terms on your behalf.

3. Accounts and Device Use

You may use core offline features without creating an account. You are responsible for your device, any backups you export, and maintaining appropriate access controls (such as a device lock). If future optional account or sync features are introduced, additional terms may apply.

4. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Stay Fit on devices you own or control for your personal, non-commercial fitness use, and to access gostay.fit for lawful purposes.

You may not:

  • Copy, modify, distribute, sell, lease, or reverse engineer the app except to the extent permitted by law
  • Circumvent security or access controls, or interfere with the Service
  • Use the Service for unlawful, harmful, or abusive purposes
  • Misrepresent affiliation with Stay Fit or use our branding without permission

5. Health and Fitness Disclaimer

Stay Fit provides general fitness tracking and workout tools for informational and personal use. The Service is not medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before beginning a new exercise program, especially if you have a medical condition, injury, or other health concern.

You use workouts and related features at your own risk. We are not responsible for injuries, health outcomes, or decisions you make based on information in the app.

6. Your Content and Data

You retain ownership of the workout logs, measurements, and other content you create in the app (“Your Content”). You are responsible for Your Content and for any backup files you export or share.

By using local backup, export, import, or share features, you understand that copies you send to third-party apps or cloud services are governed by those third parties’ terms.

7. App Stores

If you download Stay Fit from Google Play or another app store, that store’s terms also apply. In a conflict between these Terms and an app store’s mandatory terms regarding your relationship with the store, the store’s terms control for that relationship. Stay Fit, not the store, is responsible for the app to the extent described in these Terms.

8. Third-Party Services

The Service may interact with device features or link to third-party websites and services. We do not control and are not responsible for third-party services. Your use of them is at your own risk and subject to their terms and privacy policies.

9. Availability and Changes

We aim to keep Stay Fit reliable but do not guarantee uninterrupted or error-free operation. Features may change, and we may suspend or discontinue parts of the Service. We are not obligated to provide updates, though we may release them at our discretion.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAY FIT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ZERO U.S. DOLLARS IF THE SERVICE WAS PROVIDED FREE OF CHARGE.

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Stay Fit and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, Your Content, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service at any time by uninstalling the app and ceasing to visit the website. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive (including disclaimers, limitation of liability, and indemnity) will survive termination.

14. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where the Stay Fit operator is established, without regard to conflict of law principles, except where mandatory consumer protection laws in your country provide otherwise. Courts in that jurisdiction will have exclusive jurisdiction over disputes, subject to mandatory consumer rights.

15. Changes to These Terms

We may update these Terms from time to time. The “Effective date” at the top will change when we post updates. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires additional consent.
