By downloading, installing, accessing, or using the StayFit mobile application ("App") or visiting our website at gostay.fit ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Eligibility

You must be at least 13 years old to use this App. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. Medical Disclaimer (Important)

StayFit is not a medical device and does not provide medical advice.

  • The content, workouts, nutritional information, and AI-generated suggestions provided by StayFit are for informational and educational purposes only.
  • Consult a Physician: Always consult with a qualified healthcare professional before beginning any new diet, exercise program, or starting a new fitness routine, especially if you have pre-existing medical conditions.
  • Listen to Your Body: If you experience faintness, dizziness, pain, or shortness of breath at any time while exercising, you should stop immediately and seek medical attention.
  • No Doctor-Patient Relationship: Use of this App does not establish a doctor-patient relationship.
  • Assumption of Risk: You voluntarily assume all risks associated with your participation in any activities promoted by the App. StayFit is not responsible for any injuries or damages that may result from your use of the Service.

4. User Accounts

To access certain features (e.g., progress tracking, cloud sync), you must create an account.

  • Account Security: You are responsible for maintaining the confidentiality of your login credentials (email/password or social login).
  • Accuracy: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
  • Responsibility: You are fully responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.

5. User Content and Conduct

StayFit allows you to log data, upload progress photos, and potentially share information via QR codes or social features.

  • Ownership: You retain ownership of the content you submit (e.g., photos, workout logs). By submitting it, you grant StayFit a non-exclusive license to use it strictly for the purpose of providing and improving the Service (e.g., displaying your progress to you).
  • Prohibited Conduct: You agree not to:
    • Use the App for any illegal purpose.
    • Post or share content that is sexually explicit, hateful, violent, or harassing.
    • Attempt to reverse engineer, decompile, or hack the App.
    • Interfere with the operation of the Service.

6. Intellectual Property

The StayFit App, including its code, design, graphics, logos, and "StayFit" brand, is the intellectual property of the StayFit team. You are granted a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use.

7. Advertising and Monetization

The App is provided for free (or under a freemium model) and is supported by advertisements.

  • Third-Party Ads: We may display advertisements from third parties (e.g., Google AdMob, Meta Audience Network).
  • Ad Content: We do not control the specific content of third-party ads, though we strive to ensure they are appropriate.
  • Interaction: Any interaction with advertisers is solely between you and the advertiser.

8. Third-Party Services

The App may integrate with third-party services (e.g., Supabase for backend, Google/Apple for authentication). We are not responsible for the availability or content of these external services. Your use of them is subject to their respective terms and privacy policies.

9. Limitation of Liability

To the fullest extent permitted by law, StayFit and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

10. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App owners are based, without regard to its conflict of law provisions.
